On Monday, the Supreme Court upheld a key provision in Arizona’s immigration law, SB1070, while striking down three other portions, in a majority opinion written by Justice Kennedy.
The Supreme Court voted unanimously to uphold the “stop-and-check” provision, but left open the possibility that a case showing actual harm could be used to challenge the law after it goes into effect.
“So expect more litigation,” William A. Jacobson wrote at Legal Insurrection.
